(Audio) RNC, McCain and Rudy Giuliani Break the law in New Jersey by Robocalling

This just in tonight.  With the New Jersey Governor's race only a few days away the RNC is hitting voters hard in the state with illegal robocalls.

The law in New Jersey is clear, yet no politician is willing to enforce the law and few politicians actually abide by the law.

New Jersey’s toughest-in-the-nation anti-telemarketer law currently prohibits automated robocalls, yet provides exemptions if the message is introduced by an operator who first obtains the listener’s consent, or for “a prior or current relationship between the caller and the subscriber.” The lawmakers noted that some political campaigns have interpreted the “prior relationship” exemption to include any registered voter. Removing the “prior relationship” language would effectively prevent a Democrat or Republican from receiving a robocall simply because they are a member of a political party.

CA Politician Caught Red Handed Breaking The Law Banning Robocalls - Garamendi

California politicians just love breaking the law and they get away with it. 

This time it is John Garamendi who is running for Congress.  And we caught him red handed.  

Here is the audio of the latest robocall he sent to voters in the district.

This call was received at 10/28/2009, 1:16pm and came from the following caller ID # 310-510-6761.  It was received by a member of StopPoliticalCalls.org in the following town: San Ramon, CA  94582.

Why do politicians, both from the Right and Left, believe that they have the right to break the law?  Do they believe that certain laws apply to others and not to them?

California Public Utilities Code Sections 2871-2876 is pretty clear:

The California Public Utilities Code specifically makes robo calls that are not preceded by a live human operator illegal.

But, politicians continue to ignore the law.  Why?

1. Because they are arrogant.  They believe that this law should not apply to them and therefore they flaunt the law.
2. Because the voters don't know about the law and therefore don't call the politicians on it when it occurs.

What can you do?

1. Go to our CA Robocall Complaint Form.
2. Register your information with us.
3. Call your Telecom provider and ask them to enforce CA PUC Code
4. Contact the PUC directly and ask them to do their job, enforce the code that they are required by law to enforce
5. Call the offending politician / group and demand that they abide by the law or you will ask that the PUC fine them

Here is the text from the PUC:

• What can I do if I receive a robocall that I think is illegal?

1. Call your local telephone company to file a complaint. You must give them the name of who called and if possible the telephone number of the robocaller (it may be provided in the message.)
2. Your telephone company will then tell the business that it is not following the law and may give it some time to correct the problem.
3. If the business does not correct the use of the robocaller by the time given by the telephone company, the telephone company can disconnect the phone line.
4. If you are not satisfied with the telephone company’s response to your robocall complaint, you may contact the CPUC’s Consumer Affairs Branch by filing a complaint online at http://www.cpuc.ca.gov/PUC/forms/Complaints/ or by telephone at 1-800-649-7570 or in writing to:

Another last minute robocall from the DNC, sponsored by the Deeds campaign.  

Not a good idea for the Deeds campaign to call a guy that hates robocalls.    So far, not one robocall from the GOP in the Virginia Governor's race has been made to my home.

So, as a Democrat who hates robocalls, should I vote for Bob Mcdonnell ?   After all, he has respected my privacy, so far.

Reports Obama Making Robocalls for Corzine in NJ this Week, If True, Robocalls are Illegal in NJ

It looks like Obama is traveling in person to New Jersey and now via the telephone to attempt to save the New Jersey governorship for the Democrats.

Yesterday, this was reported via Twitter. 

If true, then the Obama machine (probably OFA) has violated existing New Jersey law that all but bans robocalls in the State.

Here is a link that explains NJ law.  This is more about the law:

New Jersey’s toughest-in-the-nation anti-telemarketer law currently prohibits automated robocalls, yet provides exemptions if the message is introduced by an operator who first obtains the listener’s consent, or for “a prior or current relationship between the caller and the subscriber.” The lawmakers noted that some political campaigns have interpreted the “prior relationship” exemption to include any registered voter. Removing the “prior relationship” language would effectively prevent a Democrat or Republican from receiving a robocall simply because they are a member of a political party.

Most politicians in NJ use the "Prior or current relationship between the caller and the subscriber" as a way to believe that they are following the law.

They are not.

Yeap, you heard it here.  First? 

Tom Champion, director of communications for the City of Somerville, MA is using robocalls to advertise for a town play?  Click here to listen to the audio file.

First I've heard of it.   Very weird.  Very much NOT the reason for towns to use robocalls.

Here are some good examples around why a politician / town government would want to use robocalls:

1. To get out the word on Flu clinics?  YES
2. To get out the word that election day is coming in 4 days?  Yeap
3. To get out the word that a school is in lockdown because of a shooting incident.  Yeap
4. To get out the word that there is a play in town?  Not really...

I guess politicians will use anything to connect with voters.
